PARK LINE WALSTROOM: General Terms and Conditions

The following General Terms and Conditions shall apply to the use of Walstroom shore power. If desired the latest version of the General Terms and Conditions can also be sent to you free of charge by post or by email.

General Terms and Conditions for the use of Walstroom, version 1-1-2015

Article 1 Definitions

Terms are used with the following meanings in these General Terms and Conditions:

Provider:

The party providing Walstroom shore power at public moorings. A number of public and private providers are active in various regions of the Netherlands.

Consumer:

The owner, master or shipping company making use of Walstroom shore power for a Vessel.

General Terms and Conditions:

The present General Terms and Conditions for the use of Walstroom shore power.

Operator:

The company tasked by the Provider with the provision of services relating to the use of Walstroom shore power, at this time the limited liability company Park-line Aqua BV of Diemen.

Agreement:

The agreement covering the provision and consumption of Walstroom shore power, which comes into effect with the Provider each time a Consumer connects to a Walstroom outlet.

Personal page:

A web page at www.park-line.nl/walstroom, which is accessible only to the Consumer and where the Consumer is able to view, input and amend personal data.

Vessel:

An inland navigation vessel as defined in Article 8:3 of the Civil Code, and also a vessel of restricted seaworthiness, suitable for coastal shipping.

Service and fault desk:

The Operator's Helpdesk, used for reporting the start and completion of the use of Walstroom shore power, as well as for posing questions and reporting faults. The current telephone number is 0900-464 3 464, while Consumers with a telephone subscription outside the Netherlands will use +31 (0)88 468  5440.

Consumption charges:

The applicable Walstroom tariff, multiplied by the kWh of electricity consumed.

 

Walstroom shore power:

The delivery of electricity with a maximum capacity of 200 kW from a Walstroom outlet to a Vessel.

Walstroom outlet:

A numbered outlet on shore, including an electricity meter, which the Consumer uses to connect the Vessel in order to use Walstroom shore power.

Walstroom tariff:

The tariff per kWh excluding BTW set down by the Provider for the use of Walstroom shore power at the public moorings under his control, which may vary between Providers (see Article 5 Section 1 of these General Terms and Conditions).

Walstroom facilities:

The entirety of the facilities required to make use of Walstroom shore power, including transformer houses, shore power connections, metering equipment etc.

www.park-line.nl/walstroom:

A website holding detailed information on the use of Walstroom shore power, where Consumers can also register.

All the above terms may be validly used in the singular or in the plural.

 

Article 2 – Applicability of the General Terms and Conditions

2.1

The General Terms and Conditions shall apply to every Agreement.

2.2

The most recent version of the General Terms and Conditions shall apply to the Consumer. The most recent version of the General Terms and Conditions is always published on and can be downloaded from www.park-line.nl. A copy will be sent free of charge to the Consumer by post or by email. The applicability of any General Terms and Conditions adopted by the Consumer is expressly rejected.

Article 3 – Use of Walstroom shore power

3.1

The Consumer should follow the procedure below to initiate the delivery of Walstroom shore power. Once the Consumer is moored the electrical cable is connected to a vacant Walstroom outlet. The Consumer then has a choice between the following two methods of receiving Walstroom shore power:

a. using a Consumer Number: in this case the Consumer will have registered in advance via www.park-line.nl/walstroom or in some other way. The Operator checks the Consumer's details, including the account number from which the direct debit will be taken. Following acceptance of the registration the Consumer will be given a Consumer Number and a PIN code. Use of Walstroom shore power is then initiated by means of a phone call to the number of the Service and Fault Desk, which appears on the above-mentioned website. If the Consumer telephones from the number provided during registration the number will be recognised by the Service and Fault Desk computer. The Consumer can also request the supply of Walstroom shore power by logging in to www.park-line.nl/walstroomwith his Consumer Number, PIN code and the number of the Walstroom outlet.

 

3.2

The frequency at the Walstroom outlet is 50Hz. Various types of connection are used on Walstroom shore power boxes. The following plug types are used: 230V/16A 3 pole, 400V/32A 5 pole, 400V/63A 5 pole, 400V/125A 5 pole, 400V/400A power lock system with 5 individual plugs. The plugs and the associated cabling must comply with NEN1010 and CEE and must be Kema approved. Advice on the safe use of Walstroom outlets can be found on the website at www.park-line.nl/walstroom. The Consumer is not permitted to use adaptor plugs. The connection cable and the plug must be suitable for the selected Walstroom outlet.

3.3

The Consumer must comply with all national and locally applicable acts and regulations. The consumption of Walstroom shore power does not entail the permission of the Provider for the use of the mooring. Before mooring the Consumer must make a separate mooring agreement with the provider, or apply for a permit from the Provider.

3.4

Where the connection with the Walstroom outlet is broken, the delivery of Walstroom shore power will cease automatically within 30 minutes. The previous sentence notwithstanding, a Consumer wishing to terminate the delivery of Walstroom shore power must telephone the Service and Fault Desk and go through the termination options menu. It is also possible to terminate delivery via www.park-line.nl/walstroom. The procedure for reporting termination of the delivery has two objectives, firstly to avoid continued charging for the supply of Walstroom shore power and secondly on safety considerations. Any costs arising from failure to report termination of the delivery, or from late reporting, or from the consumption of Walstroom shore power by third parties who have not registered under their own Consumer Number or credit card shall be borne by the Consumer. Any damages resulting from failure to report termination of the delivery or from late reporting shall be charged to the Consumer. During such time as the Consumer has not reported termination of the delivery of Walstroom shore power, he will receive a reminder by text message that the delivery of Walstroom shore power via the Walstroom outlet indicated by the Consumer is continuing. The Consumer can switch off this text message service via his Personal Page.

Article 4. - Operation of the Walstroom shore power system

4.1

The Provider has contracted out the provision of services relating to the use of Walstroom shore power to the Operator. The following service provision to Consumers is included:

  • The registration of Consumers and the allocation of a Consumer Number and a Personal Page on www.park-line.nl/walstroom;
  • Responses to questions and/or comments from Consumers about Walstroom shore power and its use;
  • The management and maintenance of the website www.park-line.nl/walstroom;
  • The management and maintenance of the Service and Fault Desk, which is available 7 days a week and 24 hours per day;
  • The invoicing and collection of the Consumption and Miscellaneous charges.

 

4.2

The Consumer is obligated to provide all the information and to extend all the cooperation to the Operator which the Operator may require for the provision of the services relating to the use of Walstroom shore power. The Consumer is responsible for the correct provision of information such as business details, addresses, mobile phone numbers, details of the Vessel and the bank account number or credit card number which is to be used for taking payment, whether or not via their Personal Page. Any changes to the information specified above must be reported immediately to the Operator via the Personal Page.

Article 5 – Walstroom tariff

5.1

Each Provider is responsible for setting the Walstroom tariff for the moorings under his management. The various Providers' Walstroom tariffs are set out at www.park-line.nl/walstroom. The Providers of Walstroom shore power may modify their Walstroom tariffs annually, having given advance notice on www.park-line.nl/walstroom.

 

 

5.2

The Consumer is required to remunerate the Provider for the use of Walstroom shore power, the payment consisting of the Walstroom tariff multiplied by the total of kWh which the Consumer has taken via the Walstroom outlet, plus BTW (= VAT). The total kWh consumption of electricity will be measured by the Operator with the aid of the metering equipment connected to the Walstroom outlet. High accuracy metering equipment is installed in the Walstroom boxes. In case of doubt about the accuracy of measurements the Operator's records will apply, except where the Consumer is able to provide counter-evidence.

5.3

The charge for use of the Service and Fault Desk telephone number  is €0.10 per minute plus the costs for the use of the mobile phone. These costs will be passed on by the Consumer's telephone company. With certain telephone subscriptions the costs of calling an 0900 number may be higher. Consumers should consult their telephone company for information on this topic.

Article 6 – Payment

The following stipulations shall apply where the Consumer has opted to use Walstroom shore power via their Consumer Number:

6.1

The Operator will charge the Consumer the Consumption Charges on behalf of all Providers by means of a detailed collective monthly invoice. This invoice will be provided to the Consumer via their Personal Page, but can also be sent by post on request. The Operator will handle the allocation and payment of the monies collected to the various Providers.

6.2

Consumers opting to use Walstroom shore power via their Consumer Number will provide a Direct Debit authorisation. Collection will be via the account number provided by the Consumer. The Consumer must ensure that adequate funds or credit are available in the relevant account. Where collection is delayed or proves impossible the Consumer will be legally in default 30 days following the invoice due date, and will incur statutory interest by virtue of Article 6:119a of the Civil Code. All legal and extrajudicial costs incurred in relation to the collection of monies payable by the Consumer and not paid in good time shall be borne by the Consumer. The obligation to pay the invoice may not be suspended or waived on the grounds of objections to the invoice.

6.3

The Consumer shall be legally in default in the event that he fails to pay, to pay in full or to pay in good time, or where he instructs the bank to return an amount paid by means of direct debit. The Operator is authorised to refuse the Consumer the further use of Walstroom shore power, or to allow the use of Walstroom shore power only without the Consumer Number in the case of:

a. Repeated non-payment by the Consumer;

b. Cessation of payments, declaration of bankruptcy or application of the Debt Management Natural Persons Act, or a request that the Act be applied;

c. Seizure of a significant element of the Consumer's company or other capital;

d. The winding up or the placing under Receivership of the Consumer's business;

 e. Termination of the Consumer's activities;

f. Death of the Consumer. The Provider is not liable for the consequences of a refusal by the Operator to supply Walstroom shore power to the Consumer. The following stipulation will apply where the Consumer has opted to use Walstroom shore power without a Consumer Number:

6.4

Where the Consumer has opted to use Walstroom shore power with a linked credit card, then the charges imposed by the credit card company for payment by this method shall be borne by and will be charged on to the Consumer. Only MasterCard and Visa credit cards will be accepted.

 

Article 7 – Liability for faults in the delivery of Walstroom shore power

7.1

The Provider and the Operator will do all that is reasonable to prevent faults in the delivery of Walstroom shore power. Consumers who detect faults in or damage to Walstroom equipment are requested to report these immediately to the Service and Fault Desk.

7.2

The Provider will be liable for direct damages suffered by the Consumer solely when there is intention or conscious recklessness on the part of the Provider, the Operator or any business engaged by them, with a limit of one million euros for each occurrence. A connected series of events shall be deemed to be a single event. Liability for indirect damage, including but not limited to lost profit and lost turnover, is excluded.

7.3

Faults in the electricity network, in the supply of electricity to the Provider and/or faults in the Consumer's telephone or mobile phone or internet provider's network shall be at the expense and risk of the Consumer.

Article 8 – Liability

8.1

Subject to limitations provided by Acts and regulations, the Consumer shall be liable for all damages suffered by him and for all direct damages (which are therefore not consequential damages) suffered by the Provider, the Operator and/or third parties engaged by the Operator or the Provider, as a consequence of inexpert use of Walstroom shore power and/or the Walstroom equipment, including but not limited to:

a. Incorrect connection of the Vessel to the Walstroom outlet, or failure to (correctly) disconnect the Vessel from the Walstroom outlet;

b. The use of an adaptor plug of whatever type, or a cable or a plug of a type which does not satisfy the safety standards applicable to the Walstroom outlet in question, or with an amperage less than that delivered by the Walstroom outlet in question.

c. Failure to correctly connect cables and/or plugs;

d. The drawing of more than the current permitted for the equipment in question at any one time;

e. Failure to comply with the relevant safety and/or other instructions for the use of the Walstroom facilities and/or the electrical installation on the Consumer's Vessel.

 

8.2

The Consumer hereby indemnifies the Provider and the Operator against liability for damages and costs.
